The responsible way to cover this was with a truth sandwich: A) report the truth that Biden won, B) report what Trump's supporters were saying, and C) report that those statements were false and that Biden won. Fox did B, but they largely skipped A and C for fear of losing viewers to Newsmax and OAN.
There are a lot of technicalities in play here, including who within Fox was "responsible" for the defamatory statements that aired. I don't a rooting interest either way in this case. I'm primarily concerned with what the ruling will mean for the media and for the role of truth in our society.
If Dominion wins, could it somehow weaken the Sullivan standard, set a lower bar for defamation suits, and make responsible members of the media more gun-shy about reporting the truth for fear of being sued?
If Fox wins, could it embolden irresponsible members of the media to hide behind Sullivan and spout whatever garbage they want, regardless of who it hurts? And might that inspire an outraged left to join the right in calling for tighter restrictions on press freedom? After all, if this isn't actual malice, what is?
As a reporter, I'd prefer to see a ruling that acknowledges the damage Fox did (to Dominion and to the truth) without weakening the Sullivan standard. A ruling that sends the message "Sullivan sets a high bar for defamation, and this is the rare case that clears it." An on-air apology from Fox would be nice too, but I doubt it would do much good -- a lot of folks have made up their minds that Dominion helped Biden steal the election, facts be damned.
I'm also concerned about the implications for Fox, and by extension for the conservative movement. A survey in March found that more than one-fifth of Fox viewers trust the network less because of the Dominion revelations. Yet ratings are up. So I worry that Fox might lose moderate viewers, gain far-right viewers, and veer even further toward the tinfoil hat right out of misguided loyalty to its audience. The Dominion case has demonstrated that Fox doesn't have much appetite for telling its viewers facts they don't want to hear.
Finally, isn't it fascinating how a network that rose to prominence by accusing the mainstream media of dishonesty and hypocrisy has been shown to be the most dishonest and hypocritical of them all?
